GENERAL CONDITIONS OF SALE

PREAMBLE:

These general conditions of sale govern the relationship between users of the official website of the brand LAGRANGE (https://lagrange.fr/) and the company LAGRANGE SAS, defined below.

The company LAGRANGE SAS, with a capital of 1,000,000.00 euros, registered with the RCS of Lyon under number 332 642 081, whose intra-community VAT number is FR 21 955 513 247 has a registered office located at 17 Chemin de la Plaine, ZA Les Plattes CS 30228, 69390 Vourles (France).
LAGRANGE is a French manufacturer of small household appliances established since 1955. It designs, develops and markets quality products with a strong image of originality, innovation, robustness and design. We sell accessories, spare parts and consumables through the Lagrange.fr website (https://lagrange.fr/).

ARTICLE 1. Conditions of application and acceptance of the General Conditions of Sale

These General Conditions of Sale (known as conditions of sale) are applicable to all sales concluded by LAGRANGE with its private customers through the e-site. commerce Lagrange.fr, regardless of the country from which the customer consults the site.

These conditions of sale come into force, unless otherwise stipulated, from January 1, 2018. In the event of breach of a major obligation of these conditions by one of the parties, these conditions may be immediately terminated by the other party, provided that the defaulting party is informed of the breach and cannot remedy it, or in the case of a breach which is capable of being remedied, that the defaulting party does not has not been remedied within thirty (30) days of receipt of the notification.

By using the Lagrange.fr website, the user confirms having read and accepted the General Terms and Conditions of Sale of LAGRANGE. These conditions may change and any purchase implies acceptance of the latest conditions.

ARTICLE 2. Commands

2.1 Information to be provided when ordering

The customer is responsible for the information provided when placing the order, in particular the stipulated delivery address. LAGRANGE cannot be held responsible for transport damage linked to an incorrectly entered address, and the costs incurred for the return will be borne by the customer. Customer must be 18 or older to place an order.

2.2 Identification of products ordered

The products are available on the Lagrange.fr online catalog with a button allowing them to be added to the basket. The photographs, texts, graphics and technical data sheets are the property of LAGRANGE. Due to the constraints of the web - in particular the low resolution of the images as well as the colors which can be altered by the screen - we cannot be held responsible for a minor difference between the contractual product and the delivered product.

The availability of products is visible on the product sheets thanks to the mentions "In stock" or "Temporarily out of stock". In case of many simultaneous orders, an unreported stock shortage may occur. The unavailability of a product due to a shortage of stock or its removal from the catalog may not result in any cancellation of the overall order, but only of the article mentioned.

2.3 Editing an order

If your basket on the Lagrange.fr site is not validated: it is possible to modify the quantity of items or delete items directly from your basket. You can add new products by continuing to browse, your basket is automatically saved.

In the case of a basket that has been validated (payment finalized and receipt of an order confirmation email), the order can no longer be modified. If your order is not yet in preparation, you can call customer service to cancel your order and start it again with the desired items. If your order is being prepared by our logistics department or has been dispatched, the order can no longer be modified. We advise you to refuse the package upon delivery if you wish to completely modify your order. If you wish to cancel only part of your order, receive the package and exercise your right of withdrawal. This will be refunded to you upon receipt and verification of the goods in our warehouses.

2.4 Validation of an order

The validation of an order takes place after the validation of the basket, the choice of the mode and the delivery address, the verification of the summary of the order, the acceptance of the conditions terms of sale, the choice of payment method and the validation of the payment method.

You will then receive a confirmation of your order on the screen as well as via email. If you did not receive an email, please check your junk mail and ensure that the bank payment has been finalized. You will then receive notifications as soon as the order goes into preparation, then when the goods are dispatched.

ARTICLE 3. Product prices

The prices of products distributed by LAGRANGE are those listed on the Lagrange.fr website. Prices expressed in euros include all taxes (T.T.C.) including eco-contribution, excluding any shipping costs.

The prices displayed on the website are those in force and are subject to change at any time. The time price in the event of a refund will be the one recorded in the customer order. Any dispute relating to invoicing must be made in writing within 15 clear days from the date of issue of the invoice. After this period, no complaint can be made.

ARTICLE 4. Delivery of Products

4.1. Delivery prices and destinations

Delivery costs may be charged additionally. Delivery to a Colissimo pick-up point is free for all orders over €50 including tax. Below this amount and/or if the customer chooses a different delivery method (Colissimo domicile or Chronopost domicile express), delivery costs are set according to the amount of his order.

All deliveries are made in mainland France and Belgium, no delivery can be made to overseas territories, other European countries or internationally. PO Box addresses and APO military addresses are not accepted.

The products of the same order are generally grouped but may be subject to being split into several shipments due to logistical constraints (size of products, delivery time, geographical location of warehouses, etc.) . This order splitting will not result in additional costs to the customer.

4.2. Delivery delay

The delivery times communicated are only indicative and cannot justify a refusal of goods, an order cancellation or late payment compensation.

4.3. Damaged product received on delivery

The goods travel at the risk and peril of the recipient, who must therefore refuse the package to the carrier in the event of damage, missing items or non-compliance. These reservations must be confirmed to the carrier by registered letter with acknowledgment of receipt within a maximum of 48 hours. A copy of this letter must reachLAGRANGE within the same period. Failure to complete these formalities will cause the recipient to lose all recourse against the carrier and renders any subsequent claim against LAGRANGE unenforceable.

ARTICLE 5. Return of Products

A possible return can only be made with the prior written consent of LAGRANGE, the products must be in perfect condition, in their original packaging and show no signs of damage or use. LAGRANGE reserves the right to refuse any return of goods delivered and will invoice the Customer for the cost of reshipment without this agreement.

For orders made on the Lagrange.fr site, in accordance with article L. 121-20 of the Consumer Code, the customer has a period of 14 clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, where applicable, of return costs.

The period runs from receipt for the goods. The right of withdrawal can be exercised by contacting LAGRANGE in writing to conso@lagrange.fr, who will transmit the return procedure. It is necessary to wait for the validation of our services before returning the goods. Returns of products must be made in their original condition with packaging, accessories and instructions intact so that they can be remarketed in new condition. The invoice available on Lagrange.fr must be associated with it.

Outside the 14-day period, the product cannot be returned except for manufacturing defects. Please refer to our general warranty conditions.

ARTICLE 6. Payment Terms

  • Cash payment on day of order:

Payment is due immediately upon ordering, by credit card. Payments are completely secure thanks to the SSL and 3-D Secure protocol of Payplug (Banque Populaire). This protocol aims to identify the cardholder in order to limit the fraudulent use of the cards. You may therefore be asked to confirm the purchase via a code sent to your mobile phone or via a secret question. This protocol may reject your payment if the cardholder authentication has not been validated. We invite you to contact your bank in order to continue the payment.

After verification of this information, the payment of the amount of the order is immediate and the order is validated. In case of rejected payment or failure of the transaction, the order is automatically canceled.

ARTICLE 7. Protection of personal data

ARTICLE 8. Retention of title

Notwithstanding any clause to the contrary, LAGRANGE sells subject to retention of title and without exception all the goods and merchandise it sells. This clause constitutes, in all its provisions, an essential condition without which LAGRANGE would not have contracted with the customer.

LAGRANGE remains the owner of all goods delivered until full payment of all sums due. Nevertheless and by express agreement, the goods and merchandise travel at the risk and peril of the customer. The latter, as custodian of the thing, is responsible for any damage or loss occurring during and after delivery. He must imperatively, with a view to the implementation of the retention of title, upon receipt of the goods that LAGRANGE has sold to him, refuse the package to the carrier in the event of damage, missing or not -compliance.

ARTICLE 9. After-sales service – Guarantee

In application of the LAGRANGE after-sales service charter, the guarantee granted by LAGRANGE to customers residing in mainland France is 2 years from the date of purchase certified by the date of the invoice issued in France. A third year can be applied if the request has been made via the warranty extension form available on Lagrange.fr.

To benefit from an additional year of warranty free of charge, register on the Lagrange website (https://lagrange.fr). The warranty covers parts and labor, covers manufacturing defects and return postage (outward postage being the responsibility of the Customer). Are excluded from the warranty: damage resulting from improper use or non-compliance with the instructions for use, and breakage by falling.

This warranty applies to domestic use only, under no circumstances to professional or semi-professional use. The 2-year or 2+1-year warranty is only valid for people residing and having made their purchase in metropolitan France (excluding overseas territories).

ARTICLE 10. Environmental Protection

In order to preserve our environment and our health, the end-of-life disposal of electrical appliances must be done according to very specific rules and requires the involvement of everyone, whether supplier or user. It is for this reason that your appliance, as indicated by the symbol affixed to its nameplate, must under no circumstances be thrown into a public or private trash can intended for household waste.

Upon disposal, it is your responsibility to take your device to a designated public collection center for the recycling of electrical or electronic equipment. For information on collection and recycling centers for scrapped appliances, please contact the local authorities in your area, the household waste collection services or the store where you purchased your appliance.

Under the European regulations of 2005, when you buy an item on our Site, you participate in the financing of the collection, reuse and recycling of your old device by paying an eco-contribution EEE ( Electrical or Electronic Equipment). This eco-contribution is a contribution included in the price of the products which is entirely donated to eco-organizations approved by the public authorities to manage the collection and recycling sector specific to EEE. The amount of the eco-contribution is calculated by these eco-organizations and varies according to the devices and the treatment methods.

The Lagrange company (SIRET 95551324700036) is identified in the register of producers in the EEE sector (Electrical & Electronic Equipment), pursuant to article L.541-10-13 of the Environmental Code. Its unique identifier assigned by the French Environment and Energy Management Agency (ADEME) is as follows: FR001394_05GEBU. This identifier certifies its conformity with regard to its obligation to register in the register of producers of Electrical and Electronic Equipment and the realization of its declarations of placing on the market with ECOSYSTEM.

Lagrange is also subject to the principle of Extended Producer Responsibility (EPR) for the "Packaging" sector. As such, it is registered with CITEO under the unique identifier FR211075_01MVZF.

ARTICLE 11. Liability

LAGRANGE cannot be held liable for improper use of the devices, particularly in an industrial or commercial context. It is limited to repairs of damage for which the proof and the causal link are provided by the buyer. This contractual guarantee is in addition to the legal guarantee owed by the manufacturer for hidden defects (ART.1641 and following of the Civil Code).

LAGRANGE is not responsible for temporary unavailability of the website due to technical maintenance, a problem or a computer attack.< /p>

ARTICLE 12. Attribution of jurisdiction and applicable law

The contract is governed by French law. Expressly, jurisdiction is given to the competent courts of LYON for any dispute that may arise between the parties, even in the event of summary proceedings, appeal in warranty or multiple defenders, with application of French law.
